Бізнес і права людини в умовах конфлікту: міждисциплінарні пошуки нової концепції

Анотація

У статті розглядається концепція бізнесу і прав людини, яка перебуває на стадії свого активного формування й ставить перед юридичною наукою нові питання: хто є носієм обов’язків у сфері прав людини, чи обмежена відповідальність бізнесу у сфері прав людини формальним виконанням приписів внутрішнього права держави, у чому полягає зміст вимоги до бізнесу проявляти належну обачність у сфері прав людини (human rights due diligence), якими є зобов’язання бізнесу у сфері прав людини в умовах конфлікту, яким чином держава має забезпечувати повагу до прав людини з боку бізнесу.

Пошук відповідей на ці питання потребує вироблення міждисциплінарного підходу, базованого на концепціях, які представлені різними науковими дисциплінами й які сьогодні існують відокремлено одна від одної, хоча шукають відповіді на однакові питання. У статті в цьому аспекті розглянуто також концепцію створення спільних цінностей й розвитку, орієнтованого на людину.
