Філософія права, теорія права та майбутнє теоретико-правової думки

Статтю присвячено методологічним проблемам філософсько-правової рефлексії, виявленню закономірностей і перспектив розвитку теоретикоправової думки у зв’язку із соціальними й інтелектуальними змінами, які відбуваються в сучасному світі. Автором розглядаються трансформації у філософії та теорії права протягом останніх десятиліть, зокрема зміни у предметі теоретичної юриспруденції та філософії права, які мають інтелектуальне і соціально-культурне походження. Демонструється вплив інтелектуальних тенденцій епохи на способи правового філософствування, зведення останнього до дискурс-реконструкції та дематеріалізації права, яка відбувається в ході такої реконструкції; ставиться питання про можливості та межі сучасного відродження природного права; проблематизуються перспективи юридичного позитивізму. На підставі цього вказується на можливість і необхідність реінтеграції цінностей, висловлюється припущення про об’єднання у недалекому майбутньому соцієтального й інтелектуального у філософії права.
