У статті розглядається проблема співвідношення політичної та юридичної функції прав людини переважно у конституційному контексті Британської Співдружності. Автор відстоює позицію легалізму, або етичного позитивізму, що передбачає таку модель верховенства права, згідно з якою акти про права людини мають служити, радше, не судовому, а законодавчому контролю, що сприяло б як автономії особистості, так і демократичній ефективності.
