Автор відстоює ліберальну концепцію прав людини, в основі якої — ідеї універсальності та автономії. Головна теза статті полягає в тому, що права
людини можуть бути обґрунтовані за допомогою дискурсивної теорії. Для її доведення автор робить два кроки. Крок перший — обґрунтування правил дискурсу. Крок другий — обґрунтування прав людини, який включає в себе аргумент автономії, аргумент консенсусу і аргумент демократії.
Автор констатує, що ідея дискурсу може бути реалізована тільки в демокра-
тичній правовій державі, в якій основні права і демократія нерозривно пов’язані.
