Верховенство права, або Дилема етосу: вирощування чи ме ханічне нав’язування

Постдиктаторські моделі транзиту можуть бути реалізовані або через повну поразку із збереженням військового контролю, що розриває зв’язок з минулим за допомогою превентивних локальних практик нового навчання демократії (як у період після Другої світової війни), або просто шляхом проголошення зрілого верховенства права, як це має місце сьогодні (наприклад, у ситуації посткомунізму). Практика може змінюватись залежно від того, чи є верховенство права набором абстрактних і повністю кодифікованих очікувань, чи це всього лише загальновизнаний ідеал, що виник колись у відповідь на конкретні виклики у певному місці у певний час за певних історичних обставин. У такому разі це мистецтво балансування між конкуруючими цінностями в межах його етосу: боротьба не може призвести до якогось остаточного результату, оскільки це процес навчання, в якому проявляються нові риси у відповідь на нові виклики. Зрештою має бути зроблено вибір між позиціями «циркового дресирувальника» і «садівника». Закономірно, що доведеться також зіткнутися зі спокусою замінити попередній нігілізм певним видом фетишизму, і це може посилити залежність даних країн від зразків, яким вони слідують, через послаблення їх власної відповідальності, життєво необхідної для успішного оновлення.
