Анотація

The article presents the origins and development of the legal concept of just war from Cicero do Emer de Vattel. The question about the significance of this very concept is raised. The author shows that the twiglight of the concept was caused, firstly, by the hypertrophy of the idea of state sovereignty, and secondly, by the predominance of legal positivism. Moreover, it is argued that the concept of a just war can be used effectively and in a way devoid of hypocrisy, as the ideas of Francisco de Vitoria revealed. In the author’s view, there may be room for very narrowly coined concept of just war in the contemporary international law.
