Дві концепції гідності: про занепад свободи волі у праві

Анотація

У цій статті досліджується радикальна зміна, яку ми можемо спостерігати в сучасному юридичному розумінні гідності. Те, що людину слід поважати заради неї самої, є наріжним каменем наших сучасних суспільств, що закріплене у наших законах і конституціях. Однак поняття гідності піддається принципово різним тлумаченням. Точніше, ми досліджуємо дві такі теорії гідності, а саме: “теорію гідності, засновану на свободі волі,” яка асоціюється з Іммануїлом Кантом, і “теорію гідності, засновану на добробуті,” яку нещодавно відстоював Алан Джевірт. Ми стверджуємо, що сучасний перехід від першої до другої теорії є проблематичним, по-перше, оскільки він є проявом занепаду свободи волі в наших правових системах, і, по-друге, тому що добробутна теорія гідності часто прирікає на поразку сама себе. У цій статті відповідно стверджується, що ми повинні повернутися до теорії свободи волі. Використовуючи антиномічне прочитання теорії Канта, ми стверджуємо, що раціональні люди мають бути самі собі законодавцями і що сфера законодавчої діяльності повинна бути обмежена міркуваннями гідності.
